Welcome to Mister Twister Soft Serve (www.mtsoftserve.com). By accessing our website, using our mobile application, or booking our services, you agree to be bound by the following terms.

1. Services & Bookings

  • Availability: All bookings for our ice cream vans are subject to availability. A booking is only “confirmed” once you receive written confirmation and, where applicable, a deposit has been paid.
  • Event Requirements: It is the client’s responsibility to ensure safe and legal access for our vehicles (approx. 5.5m long x 2.8m high). Mister Twister Soft Serve reserves the right to refuse service if the location is deemed unsafe or inaccessible.
  • Inaccuracies: While we strive for 100% uptime, Mister Twister Soft Serve is not liable for delays caused by traffic, mechanical failure, or incorrect location data provided by the user.

2. Payments & Cancellations

  • Pricing: All prices are in AUD and include GST unless stated otherwise.
  • Cancellations:
    • Cancellations made more than 14 days before an event may receive a full refund of the deposit.
    • Cancellations within 7–14 days may incur a 20% administration fee.
    • Cancellations within 7 days are non-refundable to cover ingredient preparation and lost opportunity.

3. Mobile App & Website Use

  • License: We grant you a personal, non-exclusive license to use the Mister Twister Soft Serve app to track our vans and access loyalty rewards.
  • Prohibited Acts: You may not attempt to reverse-engineer our app, scrape data from our website, or use our “Live Tracking” for any purpose other than locating our service.
  • Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login details.

4. Intellectual Property

  • All content on www.mtsoftserve.com and within the Mister Twister Soft Serve app—including logos, text, and software code—is the property of Mister Twister Soft Serve and is protected by Australian copyright laws.

5. Limitation of Liability

  • Food Safety: We maintain strict health and hygiene standards. However, customers are responsible for notifying staff of any allergies before ordering.
  • Property Damage: While we take every care when entering private property for events, Mister Twister Soft Serve is not liable for minor wear and tear to driveways or unsealed surfaces unless caused by gross negligence.
  • Maximum Liability: To the extent permitted by law, our total liability for any claim is limited to the amount paid by you for the service.

6. Governing Law

  • These terms are governed by the laws of Western Australia.
  • Any disputes will be resolved in the courts of WA.
